Accepted Order
means an Order which has been accepted by the Company, acceptance being indicated by an Order being signed by the Company and returned to the Customer;
"Customer Equipmentmeans any equipment owned by the customer or which is supplied by Cymraeg Wales Hosting Limited for purchase by the customer under an accepted order;
"Customer Sitemeans any premises owned, leased or licensed by the Customer and specified in a Service Order at which the Service is to be provided;
"Customer Supportmeans any assistance provided by the Cymraeg Wales Hosting Limited staff in relation to the Customers service;
"The Companymeans Cymraeg Wales Hosting Limited of 61 Somers Road Industrial Estate, Somers Road, Rugby, Warwickshire, CV22 7NA;
"Force Majeure Event" means any cause beyond a Party's reasonable control affecting the performance of its obligations hereunder including but not limited to fire, flood, explosion, accident, war, strike, embargo, acts of governmental authority (including refusal or revocation of any license or consent), Act of God, outbreak of hostilities, riot, civil disturbance, acts of terrorism, inability to secure materials, power failure, industrial disputes (excluding disputes involving employees of either Party) and acts or omissions of other providers of telecommunications services;
"Goods and or Services" means to be any item which the company provides to the customer; Networkmeans the telecommunication system over which Cymraeg Wales Hosting Limited provides the applicable Services;
"Notified Maintenance" means essential maintenance to be carried out by Cymraeg Wales Hosting Limited in relation to the Services, Hardware and/or Software, which has been notified to the Client; "Password" means those words, passwords or keys notified to the Client by Cymraeg Wales Hosting Limited which control the Clients access to some of the Services;
"Renewal Date" means the date of anniversary of the service start date;
"The Customermeans the person or company with whom goods and services are to be supplied to; "Services” means the communication or data services more particularly described on the Service Order;
"Service Chargemeans the recurring charge for use of the Service as set out in the applicable Service Order;
"Service Commencement Date” means the date set out in the applicable Service Order;
"Service Ordermeans a request for Services to be provided under the terms of this Agreement; Unmanagedmeans the company takes no responsiblity for any software and 3rd party programs used in conjunction with the service provided by Cymraeg Wales Hosting Limited;
ServerCan mean either a physical Dedicated Server or a Virtual Private Server (VPS or VDS)

2. The Service

2.1 Cymraeg Wales Hosting Limited reserve the right to decline services and goods to the customer. 2.2 Cymraeg Wales Hosting Limited does not guarantee the setup and provision of a service by a certain date unless otherwise stated in the Accepted Order. 2.3 The customer is required to ensure all software being used on the service Cymraeg Wales Hosting Limited provides is up to date and secure. 2.4 Cymraeg Wales Hosting Limited reserves the right to perform notified maintenance on all services provided to The Client and wherever possible will provide advanced notice of such maintenance. 2.5 The customer must ensure they provide Cymraeg Wales Hosting Limited with a valid name, address, telephone and email contact address. The customer must inform Cymraeg Wales Hosting Limited of any change in their contact details within three days of any changes. 2.6 Cymraeg Wales Hosting Limited may use Cymraeg Wales Hosting Limited Affiliates or sub-contractors to perform some or all of its duties and/or obligations under this Agreement. 2.7 The Customer must ensure his usage of the service provided by Cymraeg Wales Hosting Limited is within the guidelines set out in the Cymraeg Wales Hosting Limited Acceptable Usage Policy or AUP. 2.9 In the event of a server crash, once notified, Cymraeg Wales Hosting Limited will endeavour to restart The Client’s server as soon as possible but offer no timed guarantee. The Client may have access to an automatic reboot switch, in which case an instantaneous reboot may be possible. Cymraeg Wales Hosting Limited make no guarantee as to the functionality of the reboot switch, but will make all reasonable endeavours that the reboot switch is functioning properly. 2.9 The service Cymraeg Wales Hosting Limited provides is unmanaged, although the Company will attempt to provide support for any 3rd party software and programs, no gurantees is made on the level of support Cymraeg Wales Hosting Limited provides for any 3rd party software. 2.10 Any problems caused by The Customer to service, (which include, but are not limited to, deletion of necessary operating system files, accidental or intentional infection by a virus/Trojan) may result in extra charges to The Client. 2.11 1 CYMRAEG WALES HOSTING LIMITED shall have the right upon prior written notice to relocate the Customer Equipment. In the event of an emergency, CYMRAEG WALES HOSTING LIMITED may relocate the Customer Equipment within such time as may be reasonable and without prior written notice as the circumstances reasonably warrant. The site of relocation shall be comparable to the initial Licensed Space. 2.12 Subject to 20.1, CYMRAEG WALES HOSTING LIMITED reserves the right at its own expense to change the location or configuration of the Licensed Space, provided however that CYMRAEG WALES HOSTING LIMITED shall not arbitrarily or discriminatorily require such changes.


3. Payment

3.1 The Customer shall pay the Charges for the Services set out in the Service Orders. 3.2 CYMRAEG WALES HOSTING LIMITED shall be entitled 30 days before and at any time after the expiry of the Service Term to increase Service Charges for a Service upon thirty (30) days written notice to the Customer. 3.3 Cymraeg Wales Hosting Limited shall invoice the customer eight days before their service renewal date. The customer must provide notice of all cancellations prior to this, eight days before their service renewal date. 3.4 Cymraeg Wales Hosting Limited requires all invoice to be paid within ten days of creation, failure to pay an invoice by the Due Date will result in service suspension and a £10 reconnection fee will be charged. Cymraeg Wales Hosting Limited also reserves the right to prohibit the customer access to their equipment or data if the Customer has overdue invoices. 3.5 Interest shall accrue on overdue invoices from the due date until payment (whether before or after judgment) at the rate of 1.5% per month. Interest shall accrue not withstanding termination of this Agreement or any Service for whatever reason.
3.6 All sums due to CYMRAEG WALES HOSTING LIMITED are exclusive of value added tax and any other applicable sales tax or duty which shall be invoiced and payable at the then prevailing rate. 3.7 In the event that the Customer fails to make payment of any invoices in accordance with Clause 3.6, CYMRAEG WALES HOSTING LIMITED shall be entitled in addition to any other right of remedy which it might have under this Agreement or otherwise at law to set off any sums owing to it from the Customer against any deposit provided to it in accordance with Clause 2.3. 3.8 Burst charges are calculated on 95th Percentile, 5 minute average model and shall be due 14 days after the end of the month for which the burst figures were calculated upon. 3.9 The Customer hereby acknowledges and agrees that its obligations to pay all amounts and charges due hereunder, and the rights of CYMRAEG WALES HOSTING LIMITED to such payments shall be absolute, unconditional and irrevocable and shall not be affected by any circumstances of any character, including, without limitation, any set-off, abatement, counterclaim, suspension, recoupment, reductions, rescission, defense or other right or claim that Customer may have against CYMRAEG WALES HOSTING LIMITED. 3.10 CYMRAEG WALES HOSTING LIMITED reserve the right to charge a £10 fee for any hardware removal from their racks. 3.11 CYMRAEG WALES HOSTING LIMITED understands and will exercise its statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if we are not paid according to agreed credit terms.


4. Service Suspension

4.1 CYMRAEG WALES HOSTING LIMITED may, at its sole discretion and without prejudice to any right which it might have to terminate this Agreement or a Service, elect to suspend forthwith provision of any Service until further notice in the event that:
(a) CYMRAEG WALES HOSTING LIMITED is entitled to terminate this Agreement or such Service; or
(b) CYMRAEG WALES HOSTING LIMITED is obliged to comply with an order, instruction or request of government, an emergency service organisation or other competent administrative authority which affects its ability to provide the Service

4.2 CYMRAEG WALES HOSTING LIMITED may from time to time suspend a Service in accordance with any applicable SLA to carry out any necessary maintenance work to the Network or the Service Equipment. 4.3 In the event the suspension is implemented as a consequence of the breach, fault, act or omission of the Customer, the Customer shall pay CYMRAEG WALES HOSTING LIMITED all reasonable costs and expenses incurred by the implementation of such suspension and/or recommencement of the provision of the Service and CYMRAEG WALES HOSTING LIMITED may recover any other losses suffered as a result of such breach, fault, act or omission. 4.4 CYMRAEG WALES HOSTING LIMITED shall not be liable for any loss, damage or inconvenience suffered by the Customer as a result of any suspension pursuant to Clause 4.1 save where the circumstances set out in Clause 4.1 are solely attributable to the negligence of CYMRAEG WALES HOSTING LIMITED. 4.5 Any communications between CYMRAEG WALES HOSTING LIMITED and the client are strictly confidential any disclosure of telephone calls, quotations, support tickets or email communication between the parties to media organisations, other businesses, discussion forums or any other third parties is strictly prohibited and may result in immediate service suspension.


5. Indemnity

5.1 The Client agrees to fully indemnify and keep Cymraeg Wales Hosting Limited, its subsidiaries, affiliates, officers, partners, employees and agents fully indemnified from and against all actions, demands, costs (on a full indemnity basis), losses, penalties, damages, liability, claims and expenses (including but not limited to legal fees) whatsoever incurred by it or them and arising from any of the following: (i) the Clients breach of the Contract and/or this Agreement or its negligence or other act, omission or default; (ii) the operation or break down of any equipment or software owned or used by the Client but not the Hardware and/or Software; (iii) the Clients use or misuse of the Services; (iv) the Client infringing (whether innocently or knowingly) third party rights (including without limit IPRs). 6. Disclaimer 6.0 The Client acknowledges that the allocation of risk in the Contract reflects the price paid for the Services, Hardware and Software and that it is not within the control of Cymraeg Wales Hosting Limited how or for what purposes they are used. If any exclusion or limit of liability in the Contract is held to be invalid and Cymraeg Wales Hosting Limited becomes liable for loss or damage that may lawfully be limited then such liability shall be limited to the amount paid by the Client for the Services. 6.1 Cymraeg Wales Hosting Limited shall have no liability to the Client for any loss arising from any material, data or instructions supplied whether digitally or otherwise by the Client or on its behalf which is incomplete, inaccurate, illegible, out of sequence or in the wrong form or arising from late arrival or non-arrival or any other fault by the Client or on its behalf. No action, claim or demand arising out of or in connection with the Contract or this Agreement may be brought by the Client against Cymraeg Wales Hosting Limited more than one year after the cause of action has occurred. 6.2 Cymraeg Wales Hosting Limited is not responsible for any delay, malfunction, non performance and/or other degradation of performance of any of the Services, Hardware or Software caused by or resulting from any alteration, modification and/or amendments due to changes and specifications requested or implemented by the Client whether or not beyond those already supplied.
6.3 Neither Cymraeg Wales Hosting Limited nor anyone else who has been involved in the creation, production or supply of the Services, Hardware or Software shall be liable to the Client or any other person for any loss in contract, tort (including negligence or breach of statutory duty) or otherwise howsoever and whatever the cause thereof by reason of or in connection with this Agreement, the Contract or the Services, Hardware or Software for any: (i) economic loss of any kind whatsoever, or (ii) loss of profit, data, business contracts, revenues or anticipated savings, or (iii) damage to the Client's reputation or goodwill, or (iv) loss resulting from any claim made by any third party, or (v) special, indirect or consequential loss or damage of any nature whatsoever, and the Client shall indemnify Cymraeg Wales Hosting Limited from and against any claim which may be made against Cymraeg Wales Hosting Limited in respect thereof. Some jurisdictions do not allow the exclusion or limitation of implied warranties or of liability for consequential or incidental damages and therefore the above may not apply to the Client.

Cymraeg Wales Hosting Limited Acceptable Use Policy (AUP) is designed to provide a clear understanding of the regulations concerning the use of Cymraeg Wales Hosting Limited services. From time to time Cymraeg Wales Hosting Limited may impose reasonable rules and regulations regarding the use of its services.
By registering for and using the services, and thereby accepting the terms and conditions of the Terms of Service Agreement or its equivalent, you agree to abide by the AUPs as modified from time to time. Any violation of the AUPs may result in the suspension or termination of your account or such other action as Cymraeg Wales Hosting Limited deems appropriate. An unlisted activity may also be a violation of the AUPs if it is illegal, irresponsible, or disruptive use of the Internet. No credits will be issued for any interruption in service resulting from policy violations.

Customer Responsibilities
The customer is solely responsible for any breaches of security affecting servers under customer control. If a customer's server or VPS is involved in an attack on another server or system, it will be shut down and an immediate investigation will be launched to determine the cause/source of the attack. In such event, the customer is solely responsible for the cost to rectify any damage done to the customer's server/VPS and any other requirement affected by the security breach. The labour used to rectify any such damage is categorized as emergency security breach recovery and is currently charged at 50 per hour. System and Network Security Violations of system or network security are prohibited, and may result in criminal and civil liability. Cymraeg Wales Hosting Limited may investigate incidents involving such violations and may involve and will cooperate with law enforcement if a criminal violation is suspected. Examples of system or network security violations include, without limitation, the following: Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.
Interference with service to any user, host or network including, without limitation, mail bombing,
flooding, deliberate attempts to overload a system and broadcast attacks. Forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup
posting.
High-risk services, which are services which tend to attract denial of service attacks, are strictly
prohibited. This includes, but is not limited to, IRC related services and selling of shell accounts.
Violators of the policy are responsible, without limitations, for the cost of labor to clean up and correct any damage done to the operation of the network and business operations supported by the network, and to respond to complaints incurred by Cymraeg Wales Hosting Limited. Such labour is categorized as emergency security breach recovery and is currently charged at 50 per hour required. Inquiries regarding security matters may be directed to abuse@chostwales.com Cymraeg Wales Hosting Limited is concerned with the privacy of online communications and web sites. In general, the Internet is neither more nor less secure than other means of communication, including mail, facsimile, and voice telephone service, all of which can be intercepted and otherwise compromised. As a matter of prudence, however, Cymraeg Wales Hosting Limited urges its customers to assume that all of their online communications are insecure. Cymraeg Wales Hosting Limited cannot take responsibility for the security of information transmitted over Cymraeg Wales Hosting Limited facilities.


Password Protection
The customer is responsible for protecting customer's password and for any authorized or unauthorized use made of customer's password. The customer will not use or permit anyone to use Cymraeg Wales Hosting Limited service to guess passwords or to access other systems or networks without authorization.
Cymraeg Wales Hosting Limited will fully cooperate with law enforcement authorities in the detection and prosecution of illegal activity.


Contact Information
Customers are responsible for maintaining their contact information in the ticketing/billing system such that the email address is always reachable even in the event of their Cymraeg Wales Hosting Limited servers/VPS being shut down.

Internet Etiquette
The customer is expected to be familiar with and to practice good Internet etiquette (Netiquette). The
customer will comply with the rules appropriate to any network to which Cymraeg Wales Hosting Limited may provide access. The customer should not post, transmit, or permit Internet access to information the customer desires to keep confidential. The customer is not permitted to post any material that is illegal, libelous, and tortuous, indecently depicts children or is likely to result in retaliation against Cymraeg Wales Hosting Limited by offended users. Cymraeg Wales Hosting Limited reserves the right to refuse or terminate service at any time for violation of this section. This includes advertising services or sites via IRC or USENET in clear violation of the policies of the IRC channel or USENET group.
Copyright Infringement - Software Piracy Policy
The Cymraeg Wales Hosting Limited network may only be used for lawful purposes. Transmission,
distribution, or storage of any information, data or material in violation of United States or state regulation or law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or other intellectual property rights. Making unauthorized copies of software is a violation of the law, no matter how many copies you are making. If you copy, distribute or install the software in ways that the license does not allow, you are violating federal copyright law.


Network Responsibility
Customers have a responsibility to use the Cymraeg Wales Hosting Limited network responsibly which
includes, but is not limited to, respecting the other customers of Cymraeg Wales Hosting Limited. Cymraeg Wales Hosting Limited reserves the right to suspend and or cancel service with any Customer who
uses the Cymraeg Wales Hosting Limited network in such a way that adversely affects other Cymraeg Wales Hosting customers. This includes but is not limited to: Attacking or attempting to gain unauthorized access to servers and services that belong to Cymraeg Wales Hosting Limited or its customers (i.e. computer hacking), and/or Participating in behavior which results in reprisals that adversely affect the Cymraeg Wales Hosting Limited network or other customers' access to the Cymraeg Wales Hosting Limited network.
Cymraeg Wales Hosting Limited will react strongly to any use or attempted use of an Internet account or computer without the owner's authorization. Such attempts include, but are not limited to, "Internet Scanning" (tricking other people into releasing their passwords), password robbery, and security hole scanning, port scanning, etc. Any unauthorized use of accounts or computers by a Cymraeg Wales Hosting customer, whether or not the attacked account or computer belongs to Cymraeg Wales Hosting Limited, will result in severe action taken against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the seriousness of the attack.
Any attempt to undermine or cause harm to a server, or customer, of Cymraeg Wales Hosting Limited is strictly prohibited.


Lawful Purpose
All services may be used for lawful purposes only. Transmission, storage, or presentation of any
information, data or material in violation of any applicable law, regulation, or AUP is prohibited. This
includes, but is not limited to: Copyrighted material or material protected by trade secret and other statute or dissemination of harmful or fraudulent content.
Using any Cymraeg Wales Hosting Limited service or product for the purpose of participating in any activity dealing with subject matters that are prohibited under applicable law is prohibited.
Any conduct that constitutes harassment, fraud, stalking, abuse, or a violation of federal export restriction in connection with use of Cymraeg Wales Hosting Limited services or products is prohibited. Using the Cymraeg Wales Hosting Limited network to solicit the performance of any illegal activity is also prohibited, even if the activity itself is not performed. In addition, knowingly receiving or downloading a file that cannot be legally distributed, even without the act of distribution, is prohibited.
Servers/VPS hosted within Cymraeg Wales Hosting Limited network are open to the public. You are solely responsible for your usage of the Cymraeg Wales Hosting Limited network and servers and any statement you make on servers hosted within the Cymraeg Wales Hosting Limited network may be deemed "publication" of the information entered. Acknowledging the foregoing, you specifically agree not to use our service in any manner that is illegal or libelous.


Adult Content on the Internet
Cymraeg Wales Hosting Limited will provide notification and will inform any customers in writing of improper materials on our servers. Cymraeg Wales Hosting Limited reserves the right to disconnect any customers immediately. Legal adult content is still prohibited unless a request is made in writing.


Commercial Advertisements with E-mail
Cymraeg Wales Hosting Limited takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Very simply, this means that customers of Cymraeg Wales Hosting Limited may not use or permit others to use our network to transact in UCE. Customers of Cymraeg Wales Hosting Limited may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. Violations of this policy carry severe penalties, including termination of service. Sending a message, especially an advertisement, to more than five recipients, is by itself spamming unless the individuals have specifically requested to be added to a mailing list on that topic. This includes commercial advertisements and informational messages sent to recipients via electronic mail (email) as well as off-topic messages posted in Usenet discussion groups where the recipient has not requested or invited the message. Mailing lists must be true opt-in mailing lists. Before sending any email to a listed user, a confirmation email, with a tracking number, must be sent to the new subscriber, to which they must respond with a confirmation that they wish to be added to the list. You must keep these confirmations on file, so that in the case that a spam complaint is made against you, you have proof that the user did indeed opt-in.
Customers of Cymraeg Wales Hosting Limited are strictly prohibited from using or permitting others to use UCE or SPAM over our network. As our customers, if they are resellers, are ultimately responsible for the actions of their clients over the Cymraeg Wales Hosting Limited network, it is advisable that customers develop a similar, or stricter, policy for their clients.
Violation of Cymraeg Wales Hosting Limited SPAM policy will result in severe penalties. Upon notification of an alleged violation of our SPAM policy, Cymraeg Wales Hosting Limited will initiate an immediate investigation (within 48 hours of notification). During the investigation, Cymraeg Wales Hosting Limited may restrict customer access to the network to prevent further violations. If a customer is found to be in violation of our SPAM policy, Cymraeg Wales Hosting Limited may, at its sole discretion, restrict, suspend or terminate the customer's account. Further, Cymraeg Wales Hosting Limited reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. Cymraeg Wales Hosting Limited will notify law enforcement officials if the violation is believed to be a criminal offense.


USENET
Posting the same messages to multiple newsgroups (excessive cross-posting or multiple-posting, also
known as "SPAM") is expressly prohibited.
INDIRECT OR ATTEMPTED VIOLATIONS OF THE POLICY, AND ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON BEHALF OF AN Cymraeg Wales Hosting Limited CUSTOMER OR A CUSTOMER'S END USER, SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY SUCH CUSTOMER OR END USER. WE RESERVE THE RIGHT TO LEVY FINES OF £250 to £5000 GBP PER INCIDENCE OF ANY VIOLATION OF OUR POLICIES.
For Example: If you are hosting a bulk email site on Cymraeg Wales Hosting Limited servers and you use another ISP to SPAM from in order to reference your Cymraeg Wales Hosting Limited site by IP address or domain name, you are violating Cymraeg Wales Hosting Limited policy and possibly the law. If you have been granted telnet access to Cymraeg Wales Hosting Limited servers, multiple telnet log-ons are strictly prohibited and you must come from a valid IP address. Forgery is against the law. Any type of denial of service attack from valid or invalid addresses is a violation of Cymraeg Wales Hosting Limited security policy and against the law. If you have been granted password privileges for FTP or telnet, sharing your password with an unauthorized user or third party is strictly prohibited. Violation of Cymraeg Wales Hosting Limited SPAM policy may be reported to abuse@chostwales.com.


IP Address Overlap
Cymraeg Wales Hosting Limited administers the network on which customer servers reside. The customer cannot use IP addresses which were not assigned to them by Cymraeg Wales Hosting Limited staff. Any server found using IPs which were not officially assigned will be suspended from network access until such time as the IP address overlap can be corrected for which the customer will IRC
Cymraeg Wales Hosting Limited does not allow the use of IRC on the Cymraeg Wales Hosting Limited network. This includes, but is not limited to, the use of IRC clients, server software, bots or anything related to IRC. Violators' servers will be immediately suspended.


Network Performance
Cymraeg Wales Hosting Limited accounts operate on shared resources. Excessive use or abuse of these shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in termination of a customer account.
You may not use network-intensive programs, such as peer-to-peer or audio/video streaming applications on our network unless you have bought a shoutcast streaming service or have written permission off ourselves to do so. However, we do allow lite or moderate streaming from Dedicated Servers or VPS which will not have negatively impact other customers or the performance of Cymraeg Wales Hosting Limited systems or networks. Cymraeg Wales Hosting Limited reserves the right to terminate or limit such activities.


Billing
The customer understands that the customer is responsible for paying for any network resources that are used to connect the customer's server to the Internet. Pursuant to Cymraeg Wales Hosting Limited Terms of Service, the customer may request that the customer's server be disconnected from the Internet, but the customer will still be responsible for paying for any network resources used up to the point of suspension or cancellation.


Suspension
Cymraeg Wales Hosting Limited reserves the right to suspend network access to any customer if, in the judgment of the Cymraeg Wales Hosting Limited network administrators, the customer's server/VPS is the source or target of the violation of any of the other terms of the AUPs or for any other reason which Cymraeg Wales Hosting Limited reasonably chooses, including but not limited to nonpayment. If inappropriate activity is detected, all accounts of the customer in question will be deactivated until an investigation is complete. Prior notification to the Customer is not assured. In extreme cases, law enforcement will be contacted regarding the activity. The customer will not be credited for the time the customer's machines were suspended.


Cancellation
Cymraeg Wales Hosting Limited reserves the right to cancel service at any time. If inappropriate activity is detected, all accounts of the customer in question will be deactivated until an investigation is complete. Prior notification to the Customer is not assured. In extreme cases, law enforcement will be contacted regarding the activity. All fees paid in advance of cancellation are non-refundable if Cymraeg Wales Hosting Limited institutes its right of cancellation. Any violation of policies which results in extra costs will be billed to the customer (i.e. transfer, space etc.). Cymraeg Wales Hosting Limited requires all customers to provide three days notice of any cancellations.


Indemnification
The customer acknowledges its indemnification obligations under the Cymraeg Wales Hosting Limited Terms of Service. Violations of this AUP may result in significant civil and criminal liability of customer.
Disclaimer of Responsibility
Cymraeg Wales Hosting Limited is under no duty to look at each customer's or user's activities to determine if a violation of the AUPs has occurred, nor do we assume any responsibility through our AUPs to monitor or police Internet-related activities. Cymraeg Wales Hosting Limited disclaims any responsibility for any such inappropriate use and any liability to any person or party for any other person's or party's violation of this policy.


Backups
Although Nightly or twice daily backups are made of Web Hosting, Reseller Hosting, VPS’s and other data services we provide (except dedicated servers), its always good practice for the customer to take his own backups and although out of 90% of times we can restore a service from our own backups, we reserve the right to ask the customer for any backups they have, should ours be corrupt.


Age
Although we do not have a minimum age of signup to use our services, we do ask that under 18’s have written permission from there parent or guardian before signing up.


Managed Support
For Webhosting, Reseller Hosting, Shoutcast, VPS’s and Dedicated Servers, we offer managed support. We will take complete control of the server and it is the clients responsibility to tell us what they require to be done with the Service. The must be within reason and not include complicated tasks which require a support staff member to spend a significant amount of his time on this, we usually limit this to a max of 30minutes a day.

 

The above Accetpable Usage Policy refers to Web Hosting, Reseller Hosting, Shoutcast hosting (including Shoutcast VPS), Dedicated Servers, Mydrive and other support services.

Cymraeg Wales Hosting Reserves the Right to change this at any time without having to inform the customer.
